Watchdog org predicting ‘tsunami’ of coronavirus-related scams to come

Washington, DC–The National Consumers League (NCL) is warning consumers about an expected rise in attempts at fraud as the economy continues to tank and criminals pivot their pitches to take advantage of fearful consumers.

“When news captures the public’s attention – think major hurricanes, terrorist attacks, and economic slowdowns – scammers come out of the woodwork to take advantage of legitimate fears and concerns,” said NCL Executive Director Sally Greenberg. “With coronavirus dominating the news globally, there is an unprecedented opportunity for criminals to use the public’s fears about the virus and the resulting economic downturn to defraud consumers.”

NCL is working to educate consumers about two of the most pernicious types scams that are increasing due to coronavirus: robocalls and stimulus check scams.

Coronavirus-related robocalls

Robocalls are, at the very least, a major annoyance for most consumers. However, as the coronavirus has upended daily life, robocall operators have quickly shifted to blasting out spam phone calls offering all manner of coronavirus-related products and services. YouMail, a cloud-based telecommunications provider that tracks robocall volumes, estimates that at least one million robocalls per day are inundating Americans’ cell phones. Fraudulent robocallers are offering air duct sanitation services, work-from-home opportunities, cut-rate health insurance, and immune-system boosting nutritional supplements. Other robocalls have reportedly offered free insulin kits to diabetics, along with free coronavirus testing kits.

“At best, consumers who respond to these calls are setting themselves up to lose money for a non-existent product or service,” said John Breyault, director of NCL’s Fraud.org campaign. “At worst, delaying needed emergency treatments on the belief that a fake coronavirus treatment will save your life could be deadly to you and those you come into contact with.”

NCL’s advice to consumers is simple:

  1. If you receive a call from a number you don’t recognize, the safest course of action is simply to ignore the call.
  2. If you answer a call and suspect it’s a robocall, simply hang up. Don’t press any of the numbers the message tells you to.
  3. Never give any personal information, such as financial account number, Social Security number, full name, or mailing address to someone who contacts you via an unsolicited phone call or text message.
  4. Do not click on any links sent to you via text message from someone you don’t know. They could lead you to malware or phishing websites.
  5. If you’re being inundated by robocalls, your cellular provider may offer services that will increase the likelihood that the calls will be blocked.

Stimulus check scams

Last week, President Trump signed the biggest stimulus bill in U.S. history into law. Most American adults will receive a stimulus of $1,200 or more in the coming weeks thanks to the legislation. Crooks are already using these promised payments as a way to defraud consumers. Scams that have been reported involve crooks promising to expedite payment in exchange for a fee, impersonating a government official, and requesting sensitive personal information in order to process a check. Inaccurate social media posts have also circulated suggesting that consumers need to fill out the 2020 Census before they can receive a stimulus check.

“Stimulus checks will help millions of American households weather the coming economic downturn,” said Breyault. “Unfortunately, the phrase ‘free money from the government’ is magic to scammers’ ears. Consumers should be on the lookout for fraudsters who will try to use the coming stimulus checks to steal their money.”

Consumers can protect themselves from these scams by learning to spot these red flags:

  • The stimulus checks will be deposited automatically by direct deposit into consumers’ bank accounts for the vast majority of citizens who filed their taxes last year. Consumers without a bank account on record with the IRS will receive a paper check, but it may take several weeks longer to arrive than those who have bank accounts.
  • Anyone who emails, texts, messages, or calls you claiming to be able to expedite your stimulus check is a scammer.
  • Anyone who contacts you requesting sensitive information like PayPal account details, bank account information, or credit card numbers is trying to scam you.
  • Your answers to the Census, and whether you’ve completed it, have no impact on your eligibility for a stimulus check.

NCL asks consumers to share their stories by filing a complaint at Fraud.org via its secure online complaint form. Complaints are shared with NCL’s network of nearly 200 law enforcement and consumer protection agency partners who can and do put fraudsters behind bars.

National Consumers League statement on lack of airline passenger protections in COVID-19 relief bill

Washington, DC–The National Consumers League, America’s pioneering consumer and worker advocacy organization, today called the Senate’s failure to include consumer protections for airline passengers in the COVID-19 relief bill a missed opportunity to protect the flying public. The bill, which passed the Senate on a 96-0 vote and appears headed toward passage in the House of Representatives, does not contain the passenger protections, supported by consumer groups, that were in Speaker Pelosi’s proposed bill.

“Airlines are canceling flights by the hundreds, leaving consumers who have spent hundreds or thousands of dollars on planned vacations and other travel high and dry. We are seeing disturbing reports that those customers, whose flights were canceled through no fault of their own, are being given the run-around by the airlines when they try to get a refund. A one-year flight voucher is of no use to consumers who don’t know when the current COVID-19 outbreak will subside.

In spite of this, the Senate approved a COVID-19 relief that did not require even the most basic of passenger protections of the airlines. While we applaud Congress for putting checks into the hands of the most vulnerable consumers and protecting the livelihood of millions of airline workers, it should have done more to protect the passengers who are the lifeblood of the industry. It is likely that this will not be the last time that the airlines come to Congress asking for a taxpayer bailout due to the COVID-19 outbreak. NCL will continue to press our elected representatives to ensure that consumers’ needs are not left unaddressed in the next relief bill.”

NCL praises AG Barr for crackdown on COVID-19 scammers

Washington, DC–The National Consumers League (NCL) is applauding efforts by the Department of Justice and U.S. Attorney General William Barr to crack down on a wave of scammers and hackers trying to capitalize on the COVID-19 outbreak by ordering U.S. attorneys offices across the country to investigate and prosecute “all criminal conduct related to the current pandemic.” NCL greatly supports the move to make this a priority.

NCL operates a fraud prevention and education program, Fraud.org, working with law enforcement agencies in the U.S. and Canada to track trends in fraudulent activity. NCL also runs the Alliance Against Fraud, a coalition of nonprofits, government, and businesses dedicated to fraud awareness, prevention, and supporting criminal prosecution of fraudulent business practices. The League also works to advocate for science- and evidence-based claims about healthcare, foods, and dietary supplements.

As Barr noted earlier this week, “[i]n particular, there have been reports of individuals and businesses selling fake cures for COVID-19 online and engaging in other forms of fraud, reports of phishing emails from entities posing as the World Health Organization or the Centers for Disease Control and Prevention.”

“AG Barr is right; we’re seeing an upsurge in phishing emails purporting to be from public health organizations offering information on the coronavirus outbreak,” said NCL Executive Director Sally Greenberg. “During this time of vulnerability and uncertainty, consumers shouldn’t be left to fend for themselves in determining whether the claims they are seeing are true. We are pleased that the Trump Administration is taking the risks of scammers capitalizing on this global crisis seriously.”

In his letter, the Attorney General also pointed to recent reports about “malware being inserted onto mobile apps designed to track the spread of the virus.” Last week, an Android app called “COVID-19 Tracker App” surfaced. It’s actually a piece of ransomware designed to lock down access to a consumer’s phone.

National Consumers League statement on airline consumer protections in Take Responsibility for Workers and Families Act

Washington, DC–The National Consumers League, America’s pioneering consumer and worker advocacy organization, today called on leaders in the U.S. Senate and House of Representatives to support the consumer protection provisions in the “Take Responsibility for Workers and Families Act,” (H.R. 6379) the COVID-19 relief legislation introduced by Congresswoman Nita Lowey (D-NY). These provisions would prohibit airline price gouging (Sec. 601) and require full cash refunds for cancelled flights (Sec. 602) during the national COVID-19 emergency. In addition, the bill would require that airlines provide quarterly reports to the Department of Transportation on the revenue they collect from baggage, change/cancellation, seat reservations, and other add-on fees.

NCL, along with a coalition of consumer and passenger rights groups, last week called on Congress to include a series of consumer protection measures in any airline bailout legislation. The proposed protections would address passengers’ concerns during the current emergency as well as broader structural issues in the airline industry going forward.

Washington, DC—The National Consumers League (NCL), America’s pioneering consumer and worker advocacy organization, today applauded the Federal Trade Commission (FTC) and Food and Drug Administration (FDA) for cracking down on vendors selling purported “cures” for the deadly coronavirus. In letters sent to seven companies, the agencies rightly warned that companies seeking to profit off of the “high level of anxiety” consumers are experiencing due to the coronavirus outbreak may be violating federal consumer protection statutes.

“Americans are right to be concerned about the spread of the COVID-19 coronavirus. McKinley Tech High School Wins 2019 National Consumers League’s Washington, DC LifeSmarts Competition

Washington, DC— LifeSmarts announced today that McKinley Tech High School’s Phoenixes Team was named the winner of the 2020 Washington, DC LifeSmarts Competition. The competition, hosted by the University of the District of Columbia David A Clarke School of Law, and the National Consumers League (NCL), tested local high school teams, comprised of teens in grades 9-12, about personal finance, health and safety, the environment, technology and consumer rights and responsibilities. McKinley Tech Phoenixes will represent Washington, DC at the 26th annual National LifeSmarts Championship in April in Crystal City, VA. Comcast, a sponsor of the competition, awarded the team a $5,000 scholarship for travel expenses. 

“We were very excited to host the competition for DC once again this year. Students learn valuable skills and become savvy consumers by showcasing their knowledge in LifeSmarts competitions,” said Sally Greenberg, NCL Executive Director.

During the competition held Friday, February 21, local high school teams from Columbia Heights Educational Campus; McKinley Technical High School; and the UPO Power Program competed individually and in buzzer-style matches, answering questions about consumer issues that impact everyday life.

NCL commends House passage of anti-tobacco bill

Washington, DC—The National Consumers League (NCL) applauds the passage by the House of Representatives of the Reversing the Youth Tobacco Epidemic Act of 2019 (H.R. 2339), legislation that aims to address youth smoking and e-cigarette crisis. NCL supports the work of the Association of Black Cardiologists, Black Women’s Health Imperative, National Medical Association, National Black Nurses Association, and the National African American Tobacco Prevention Network—among others—all of whom have helped advance this bill.

According to the National Youth Tobacco Survey, *5 million youth reported having used e-cigarettes, 1 million of which reported daily use. There has been a *78 percent increase in consumption of e-cigarettes among high school students and a *48 percent growth in consumption among middle school students. The proliferation of e-cigarettes in the marketplace has jeopardized decades of progress made by smoking cessation advocates.

For generations, tobacco companies have disproportionately targeted the African American community with advertisements for tobacco products that appear on average, 10 times more in African American neighborhoods than anywhere else. The most staggering example of this is highly addictive and harder-to-quit menthol cigarettes, which have long been marketed to the African American community. Even more concerning is that *seven out of ten African American youth smokers ages 12 to 17 smoke menthol cigarettes.

H.R. 2339 aims to revise requirements related to the safety, sale, and advertisement of tobacco products, including electronic nicotine delivery systems (ENDS), such as e-cigarettes and similar devices. The bill will address the deceptive marketing practices deployed by e-cigarette companies that lure and entice young people with their packaging. The legislation views e-cigarettes as on par with traditional tobacco products under the law and makes it clear that selling tobacco products to children, in any modality is *illegal.

“The National Consumers League applauds Rep. Frank Pallone (D-NJ) and Rep. Donna Shalala (D-FL) for their leadership on this legislation,” said NCL Executive Director Sally Greenberg. “We urge the Senate to join in this fight to help end efforts by tobacco and e-cigarette companies to target vulnerable communities nationwide with biased marketing tactics.”

Imposter scams drive big increases in phishing and spoofing complaints in annual top ten scam report

Washington, DC—Consumers on the receiving end of scary calls and emails claiming that the government is coming after them drove a big increase in phishing and spoofing complaints to the National Consumers League’s Fraud.org campaign in 2019, according to the organization’s annual Top Ten Scams report issued today. With National Consumer Protection Week 2020 kicking off this weekend and being observed next week (March 1-7), the national consumer watchdog org is cautioning consumers against imposter frauds and the other most common scams that plagued Americans in 2019. 

In 2019, consumers submitted 5,647 complaints to Fraud.org. Fifty-three percent of complaints reported a monetary loss; the median loss reported was $749. 

In 2019, the percentage of complaints Fraud.org received about scams involving phishing or spoofing nearly tripled versus the previous year. NCL attributes the increase to the high number of imposter scam calls that consumers reported receiving. Scammers reportedly impersonated government agencies such as the IRS, FBI, and USCIS, and some of these criminals even claimed to be representatives of the National Consumers League.  

“Scammers know all too well that impersonating a government agency and threatening consumers is one of the best ways to get victims to pay up, and they depend on authentic-looking emails or spoofing Caller ID to get victims to pay attention to their threats,” said John Breyault, NCL Vice President of Public Policy, Telecommunications, and Fraud and the new report’s author. “The best advice for consumers is to remember that a government agency will never reach out to you via email or telephone to demand money, so hang up or delete. If you’re worried about back-taxes, your immigration status, or a debt you may owe, look up the phone number for the bank or government agency yourself and call to check. Don’t take the word of someone on the phone making threats.”

Other topline findings from the report include: 

Romance scams and friendship swindles on the rise in 2019. 

The percentage of complaints involving romance scams increased by nearly 50 percent versus 2018. This is especially worrisome considering that romance scams tend to be among the most expensive type of fraud for victims. 

Web remains most common place scammers are finding victims. 

While the telephone was the method of first contact used by scammers in nearly a third of complaints to Fraud.org in 2019, the Internet remains the most likely place for complainants to have encountered a scammer. Almost 45 percent of complaints to Fraud.org in 2019 said that they first encountered a scammer on the Web. 

Wire transfer no longer scammers’ top choice of payment method. 

After many years of wire transfer being the payment method of choice by scammers, credit cards bumped wire transfers as the most frequently-reported method of payment in 2019. More than 44 percent of complainants to Fraud.org reported that their loss occurred because a scammer charged their credit card.

Consumer groups applaud House hearing on anti-consumer practices in the ticketing industry

Washington, DC—The National Consumers League, Consumer Reports, Sports Fans Coalition, Fan Freedom, and Public Knowledge commend Chairwoman DeGette and members of the House Oversight and Investigations Subcommittee for convening the hearing, “In the Dark: Lack of Transparency in the Live Event Ticketing Industry.” Rife with fraud, deceptive marketing prices, and opaque restrictions on transferability, the live event ticket marketplace is one of the least consumer-friendly marketplaces available.

“The live event market is rigged against fans. It is rigged by a billion-dollar ticketing monopoly, rigged by unscrupulous scalpers who continue to use illegal ticket bots, and rigged by artists and promoters who would rather point fingers than bring transparency to the marketplace,” said John Breyault, Vice President of Public Policy, Telecommunications, and Fraud for the National Consumers League. “They say that sunshine is the best disinfectant. It is our hope that today’s hearing will be a step toward cleaning up a broken industry and holding the executives who run it to account for their anti-fan business practices.”

“We’ve heard from thousands of people across the country frustrated with being ambushed by sneaky fees that jack up the price of event tickets,” said Anna Laitin, Director of Financial Policy for Consumer Reports. “Companies should be required to advertise ticket prices with all mandatory fees included so there are no surprises and consumers know exactly how much they’ll pay.”

“The same things that harm concert fans harm sports fans,” said Brian Hess, Executive Director of Sports Fans Coalition. “Fans deserve the right to transfer their ticket. Whether that is because they want to give a ticket to a family member, or try to sell it to recoup some costs if they can no longer attend the game. Restrictions on this right, ruin the fan experience and make it harder for fans, especially older fans, to enjoy the teams they’ve invested in.”

“Fan Freedom applauds the Oversight and Investigations Subcommittee for examining live event ticketing,” said Chris VanDeHoef, Fan Freedom President. “The industry is tilted in favor of the Live Nation Entertainment monopoly at the expense of music, sports and theater fans everywhere. We believe the BOSS Act begins the process of shifting power back into the hands of consumers.”

“Ticketmaster’s ability to leverage the ticketing portion of its business alongside the concert promotion portion of its business, Live Nation, is a classic example of anticompetitive behavior,” said Bertram Lee, Policy Counsel with Public Knowledge, “ Live Nation has refused to bring artists to venues that don’t use Ticketmaster, and this kind of anticompetitive behavior impacts both consumers and artists. Neither artists nor consumers who use Ticketmaster or Live Nation are able to take advantage of better prices or terms in the larger ticketing and venue marketplace.”

Many of the ills that plague this marketplace could be resolved by the passage of the Better Oversight of Secondary Sales and Accountability in Concert Ticketing Act (HR 3248) as introduced by Congressman Pascrell (D NJ-9). The bill would require ticket sellers to adopt all-in pricing instead of hitting consumers with several fees at the end of check out, prohibit non-transferable tickets, require disclosures of how many tickets are being sold to the general public, and many more vital consumer protections. Following today’s hearing, the National Consumers League, Consumer Reports, Sports Fans Coalition, Fan Freedom, and Public Knowledge urges each member of the committee to cosponsor the BOSS Act to adequately address the myriad of harms that will be brought to light during this hearing.

About Sports Fans Coalition: Sports Fans Coalition was founded on the idea that sports fans deserve an advocate, someone who will stand up to the big sports leagues when they flex their political muscle, bully government officials or businesses, and attempt to harm the fan. Over the years, we have successfully supported fans across the country by overturning the Sports Blackout Rule; advocating for player safety; opposing publicly funded sports stadium construction unless fans receive a commensurate benefit, such as reduced ticket prices or free tickets for military personnel and retirees; protecting fans against ticket resale fraud; and drafting the Sports Bettors’ Bill of Rights, a set of consumer protections to promote safer sports betting.
