Cincinnati resident Charles, 45, lost his computer business — and health insurance— during a time of economic downturn. A diabetic, Charles was now unable to afford his medication. He stopped taking it which made him seriously ill and put his life at risk.

On May 17, the National Consumers League (NCL) brought patient advocates and policy experts together for a virtual advocacy briefing on the patient value of copay assistance programs and the unintended consequences that the CMS Best Price Rule could have on patient access and affordability. Of particular note, the NCL briefing event coincided with the U.S. District Court for the District of Columbia granting a summary judgement motion in the case of PhRMA vs. Xavier Becerra as it relates to the “Best Price” provision of the rule.

Summary judgement is a final determination unless it is appealed. During the one-hour Zoom webinar, representatives from NCL, Avalere, the HIV+Hepatitis Policy Institute, and American Cancer Society Cancer Action Network discussed the role that copay assistance plays to help patients afford and adhere to their medications. Panelists also noted how the CMS Best Price Rule, finalized by the Trump Administration in 2020, threatens patient access to these critical programs, and what the summary judgement means for patients.
